What is 179D

The 179D commercial buildings energy efficiency tax deduction enables building owners and designers to claim a tax deduction for installing qualifying systems and buildings. The systems and buildings must have been placed in service after December 31, 2005.  Deductions are taken in the year in which systems  and buildings are placed in service.  The 179D tax deduction has been in effect since January 1, 2006.

How Does It Work?

A tax deduction of $1.88 per square foot is available for buildings installed with interior lighting, building envelope, and/or heating, cooling, ventilation, or hot water systems that reduce the building's total energy and power cost by 50% or more in comparison to a building meeting minimum requirements set by ASHRAE Standard 90.1-2007(buildings placed in service before Dec.31,2020). Buildings placed in service on or after Jan. 1, 2021 shall use the most recent Standard 90.1.

  Deductions of $0.63 per square foot are available for building in which individual lighting, building envelope, or heating and cooling systems that partially qualify.

Deductions of $0.63 per square foot are available to owners of buildings in which individual lighting, building envelope, or heating and cooling systems that partially qualify be meeting certain target levels or through the interim lighting rule. These three compliance pathways are shown in the table above.

Building Owners

Building owners that have built or renovated commercial buildings are eligible for the 179D deduction.  If the building was constructed or retrofitted between 2006 and 2022, the 179D tax deduction provides the building owner with immediate deductions for energy efficient designs or upgrades that can be placed on the current tax year.

Designers

Government buildings are not subject to tax, hence the owners can not claim the deduction. Building designers are eligible to claim the 179D deduction!!! Engineers, Architects, and General Contractors are professional service firms that can benefit from this deduction.
